Subway® Sub Club Terms

These Subway® Sub Club Terms (“Sub Club Terms”), together with the terms governing your access to and use of our websites and mobile apps, as applicable, govern your participation in the Subway® Sub Club program. These Terms form a binding contract between you and Subway MyWay LLC (as applicable, “Subway®,” “we,” “us,” or “our”). Our websites and mobile apps are, together, referred to as the “Site(s)”.
By clicking “JOIN SUB CLUB”, you agree that you have read and understand these Terms.
Sub Club Terms include and are subject to the terms governing your access to and use of the applicable Site(s) (the “Site Terms”), for example and as applicable, our Terms of Use and our Order Terms.
While we operate Sub Club program, neither we nor any of our affiliates is responsible for the operation of Subway® restaurants. Instead, Subway® restaurants are owned and operated by independent franchisees. Each restaurant is solely and independently responsible for any issues relating to the sale of products to you.
Except where prohibited by applicable law, we reserve the right to modify Sub Club Terms at any time. All changes will be effective immediately upon posting to the Site and, by accessing or using the Site after changes are posted, you agree to those changes. Material changes will be prominently posted on the Site.

Instead, Subway® restaurants are owned and operated by independent franchisees. Each restaurant is solely and independently responsible for any issues relating to the sale of products to you.
Except where prohibited by applicable law, we reserve the right to modify Sub Club Terms at any time. All changes will be effective immediately upon posting to the Site and, by accessing or using the Site after changes are posted, you agree to those changes. Material changes will be prominently posted on the Site.
1. Geographic Scope & General Requirements
The Subway Sub Club program (“Subway® Sub Club” or the “Program”) is operated by us on behalf of participating Subway® restaurants in the United States, District of Columbia, Puerto Rico, Guam, Northern Mariana Islands, and on certain international U.S. military installations, which includes certain Army & Air Forces Exchange Service (“AAFES”) and Navy Exchange Service Command (“NEXCOM”) locations (AAFES and NEXCOM locations, together, “international U.S. military locations”); (together, the “United States Territory”).
We reserve the right to change, modify and/or eliminate Subway® Sub Club, and/or all or any portion of FAQ, or guideline pertaining to Subway® Sub Club at any time and at our sole discretion. Any changes or modifications will be effective immediately upon posting the changes which may be accessed through the Site. Your continued participation in, or access to Subway® Sub Club confirms your acceptance of these Sub Club Terms and any changes or modifications to these Sub Club Terms. You should review these Terms and our policies and FAQs frequently to understand the terms and conditions that apply to your enrollment and participation in Subway® Sub Club.
Subway® Sub Club is intended for individual use only. Commercial use is prohibited. To participate you must be a legal resident of the United States Territory. Subway® Sub Club is not targeted toward, nor intended for use by, anyone under the age of 18. If you register for Subway® Sub Club you must be 18 years of age or older to participate. Enrollment and participation in Subway® Sub Club is complimentary.
We reserve the right to change, modify and/or eliminate Subway® Sub Club, and/or all or any portion of FAQ, or guideline pertaining to Subway® Sub Club at any time and at our sole discretion. Any changes or modifications will be effective immediately upon posting the changes which may be accessed through the Site. 2. Subway® Sub Club Account
Your Subway® Sub Club account is personal to you, and you can only have one Subway® Sub Club account. Your Subway® Sub Club account and any associated Stamps, Points, Subway® Cash, Free Footlong Coupons and other Rewards cannot be sold, transferred, assigned to, or shared with, family, friends, or others.
If we discover that you have more than one account, we reserve the right to terminate any and all of your accounts, and you shall immediately forfeit all Stamps, Points, Subway® Cash, Free Footlong Coupons, and Rewards upon such termination. You are responsible for ensuring that no unauthorized person has access to your Subway® Sub Club account or your Subway® Card (“Card”). You are responsible for all activity on your Subway® Sub Club account.
Without notice to you and in our sole discretion, we reserve the right to suspend or terminate your Subway® Sub Club account or access to your account if we determine that you have violated these Sub Club Terms or the Site Terms of Use, that there has been fraudulent, deceptive, or unlawful activity on your account, or for the performance of routine or non-routine maintenance, error correction or for any other purpose. If we terminate your Subway® Sub Club account, you shall immediately forfeit all associated Stamps, Points, Subway® Cash, Free Footlong Coupons and Rewards.
If we discover that you have more than one account, we reserve the right to terminate any and all of your accounts, and you shall immediately forfeit all Stamps, Points, Subway® Cash, Free Footlong Coupons, and Rewards upon such termination. You are responsible for ensuring that no unauthorized person has access to your Subway® Sub Club account or your Subway® Card (“Card”). You are responsible for all activity on your Subway® Sub Club account.

3. Availability
Subway® Sub Club availability is subject to Subway® restaurant participation. Some Subway® restaurants may not participate in Subway® Sub Club. Ask prior to placing your order or call ahead to the applicable Subway® restaurant to confirm if you can earn Stamps and Points or redeem Subway® Cash, Free Footlong Coupons, and other Rewards at that specific Subway® restaurant. Some features of Subway® Sub Club, such as the ability to scan your account information via the Subway® App, may not be available in certain locations.
4. How to Enroll & Communications
To begin earning Stamps and Points when ordering food items or other products at a participating Subway® restaurant that are eligible (“Eligible Items”), you can enroll in the Sub Club through the Site(s) (including, as applicable, through the Subway® App). You will not be able to enroll through any other means, and you will need to agree to these Sub Club Terms to enroll and participate in Subway® Sub Club. Please note that Eligible Items are different for earning Stamps and Points and may change depending on availability and at the discretion of the specific participating Subway® restaurant.
As a condition of membership in Subway® Sub Club, you will be asked to provide a valid email when you enroll, which we, our affiliates, and our and their respective designees and service providers will use to contact you about your account, Stamp and Points balance, available Subway® Cash, Free Footlong Coupons, and Rewards, and as otherwise permitted by applicable law. We may also send you such communications via the Subway® App if you choose to receive push notifications. You can opt out of receiving any such push notifications by changing your device settings. You may also receive a push notification or email during the checkout process in a Subway® restaurant.
As a condition of membership in Subway® Sub Club, you will be asked to provide a valid email when you enroll, which we, our affiliates, and our and their respective designees and service providers will use to contact you about your account, Stamp and Points balance, available Subway® Cash, Free Footlong Coupons, and Rewards, and as otherwise permitted by applicable law. We may also send you such communications via the Subway® App if you choose to receive push notifications. You can opt out of receiving any such push notifications by changing your device settings. You may also receive a push notification or email during the checkout process in a Subway® restaurant.
5. Linking Your Card: Digital and Plastic
Once you have successfully enrolled in Subway® Sub Club you will be assigned a Sub Club account (“Sub Club Account”) that is accessible via the Sites upon login. You may choose to link your Sub Club Account to your Card, which can be obtained from any participating Subway® restaurant, subject to availability. Once your Sub Cub Account is linked to your Card, the Card can then be used as identification when earning and redeeming Stamps, Points, Subway® Cash, Free Footlong Coupons and Rewards at participating Subway® restaurants.
6. Earning Stamps, Points and Rewards
As a Subway® Sub Club member, you can earn Stamps and Points on Eligible Items that you purchase at participating Subway® restaurants, both in-restaurant and through placing an order through the Sites (“Online Ordering”). Online Orders are subject to additional Order Terms.
Before completing a purchase you must identify yourself as a Subway® Sub Club member by either providing the phone number associated with your Sub Club Account, scanning your Sub Club Account information via the QR code available in the Subway® App, or swiping your Card (if already registered and connected to your Sub Club Account).
Stamps:
As a Subway® Sub Club member, you earn Stamps on Eligible Items that you purchase at participating Subway® restaurants, both in-restaurant and through Online Ordering. Stamp Eligible Items include footlong and six-inch subs. Members will earn one (1) stamp for each footlong sub purchase and one-half (½) stamp for each six-inch sub purchase. You can view your Stamps on the digital ticket tape. Stamps are automatically added to your account within twenty-four (24) hours. Once you accumulate three (3) full stamps, a Free Footlong Coupon will be added to your that can be redeemed for a free footlong sub (“Free Footlong Coupon”) Sub Club Account. There is no limit to the number of Free Footlong Coupons that can be redeemed in a single transaction. Add-ons (which are listed on the menu) are not included in Free Footlong Coupon value and additional charges for Add-ons will be added to your order total. Other limitations may apply and will be noted directly on the relevant Free Footlong Coupon.
Points:
As a Subway® Sub Club member, you earn Points on Eligible Items that you purchase at participating Subway® restaurants, both in-restaurant and through Online Ordering. Point Eligible Items include most standard menu items. Exclusions may apply.
In some instances, you may earn Points through a promotion or campaign that we sponsor (“Eligible Campaigns”). Your eligibility to earn Points through an Eligible Campaign (if applicable and only as available) is dependent on your acceptance and compliance with the applicable Eligible Campaign’s terms and conditions.
Except for Points earned through Eligible Campaigns, Points are automatically added to your account within twenty-four (24) hours. Points are awarded based on your total purchase (less the exclusions listed below) and are rounded up or down to the nearest dollar, prior to sales and discounts.
Some exclusions apply. You cannot earn Points on purchases of alcoholic beverages or of gift cards (including gift card purchases, activations, reloads, transfers, or any other card-to-card transaction). Taxes, tips, donations, fees (including, for example, delivery fees), bottle and can deposits, and bag fees (or bag taxes, as applicable) are also excluded and ineligible for Points awards. Online Orders placed through third party ordering services are not eligible for Points awards. We reserve the right to place limits on the number of Points you can earn on a daily and/or monthly basis.
Bonus Points may be awarded based on your purchase of or participation in a promotional offer. Bonus Points will be awarded as described in a promotional offer and may be subject to additional terms that are stated in the applicable promotional offer.
Four hundred (400) Points is equivalent to two dollars ($2.00) in Subway® Cash (“Subway® Cash”). Once your balance reaches 400 Points, you have earned $2.00 in Subway® Cash which can be redeemed as a discount on your next Subway® order. Points are not converted into Subway ® Cash prior to redemption. Points can also be accumulated and redeemed in multiples of $2.00. For example, 1200 Points can be accumulated and redeemed as $6.00 in Subway® Cash. Subway® Cash is unique to your Sub Club Account, and may only be used by you at participating Subway® locations.
Rewards:
In addition to earning Stamps and Points, you may also be eligible to receive other Rewards on occasion (if applicable and subject to availability). These are not Stamp or Points-based offers and may be subject to additional terms and conditions that must be accepted or met in order to redeem the applicable promotional offer which will be stated in the Reward.
IMPORTANT NOTE:
Subway® Cash and Free Footlong Coupons are not gift certificates. All Stamps, Points, Subway® Cash, Free Footlong Coupons, and all other Rewards are promotional, have no cash value, and cannot be exchanged for cash or converted to a gift card balance.
Except for redeeming Points for Subway® Cash or Stamps for Free Footlong Coupons in accordance with these Sub Club Terms, Points and Stamps have no value and may not be exchanged for cash or otherwise.
You will lose any extra balance on a $2 Subway® Cash redemption that exceeds the bill amount. For example, if you use $4 Subway® Cash on a subtotal amount of $3.50, you will lose the remaining $0.50 from the second $2 applied in Subway® Cash.
All Stamps, Points, Subway® Cash, Free Footlong Coupons and other Rewards will expire on termination of your enrollment in Subway® Sub Club (whether terminated by you or by us) or termination of the Subway® Sub Club altogether, subject only to notice that is required by applicable law, if any.

7. How to Redeem Subway® Cash, Free Footlong Coupons, and other Rewards
Subway® Cash, Free Footlong Coupons and/or Rewards are redeemable at a participating Subway® restaurant in the United States Territory.
To redeem Subway® Cash, Free Footlong Coupons and/or other Rewards at a participating Subway® restaurant, you must identify yourself as a Subway® Sub Club member by either providing the phone number associated with your Sub Club Account, scanning your Sub Club Account information via the Subway® App, or swiping a registered Card before completing your purchase.
You can choose whether you want to apply the Subway® Cash, Free Footlong Coupon(s) and/or other Reward(s) (if available) to your current purchase or not. Even if you choose not to redeem Subway® Cash, Free Footlong Coupon, or other Reward, identify yourself as a Subway® Sub Club member so you can earn more Stamps and Points and so that the participating Subway® restaurant can check to see if there are any other promotional offers you might be eligible for (subject to availability) instead of, or in addition to, your Subway® Cash, Free Footlong Coupon, and/or other Reward.
You will be able to redeem your Subway® Cash, Free Footlong Coupon and/or other Reward using Online Ordering through the Sites. You may apply up to $50 in Subway® Cash to cover your subtotal balance (after discount is applied but before sales tax). Subway® Cash, Free Footlong Coupons and other Rewards cannot be used for catering or delivery orders placed through a third-party services (e.g. EZ Cater or UberEATS).
If Subway® Cash, Free Footlong Coupon or other Reward has been redeemed, it will no longer be valid for future purchases.
To redeem Subway® Cash, Free Footlong Coupons and/or other Rewards at a participating Subway® restaurant, you must identify yourself as a Subway® Sub Club member by either providing the phone number associated with your Sub Club Account, scanning your Sub Club Account information via the Subway® App, or swiping a registered Card before completing your purchase.
You can choose whether you want to apply the Subway® Cash, Free Footlong Coupon(s) and/or other Reward(s) (if available) to your current purchase or not. Even if you choose not to redeem Subway® Cash, Free Footlong Coupon, or other Reward, identify yourself as a Subway® Sub Club member so you can earn more Stamps and Points and so that the participating Subway® restaurant can check to see if there are any other promotional offers you might be eligible for (subject to availability) instead of, or in addition to, your Subway® Cash, Free Footlong Coupon, and/or other Reward.
You will be able to redeem your Subway® Cash, Free Footlong Coupon and/or other Reward using Online Ordering through the Sites. You may apply up to $50 in Subway® Cash to cover your subtotal balance (after discount is applied but before sales tax). Subway® Cash, Free Footlong Coupons and other Rewards cannot be used for catering or delivery orders placed through a third-party services (e.g. EZ Cater or UberEATS).
If Subway® Cash, Free Footlong Coupon or other Reward has been redeemed, it will no longer be valid for future purchases.
8. Void Stamps, Points and Rewards
Any Stamps, Points or Rewards you were awarded from a transaction that is later voided for any reason, shall be deducted from your Subway® Sub Club account balance.
9. Suspension & Cancellation
Without notice to you, all earning, and redemption activities shall be suspended on Subway® Sub Club accounts that have been “frozen” due to actual or suspected fraudulent activity, as determined by us in our sole discretion.
To cancel your membership at any time, please contact Guest Care using the link below. Your membership in Subway® Sub Club will be terminated within thirty (30) days and, subject only to any notice that may be required by law, all Points, Stamps, Subway® Cash, Free Footlong Coupon, and all other Rewards will expire and become void upon the date of termination.

10. Missing Transactions
If you forget to identify yourself as a Subway® Sub Club member prior to checkout in restaurant you can utilize our missing transaction process, as detailed in these Sub Club Terms below.
You may be able submit a “Missing Transactions” request form via the Sites for a purchase that has occurred within the preceding thirty (30) days. While filling out this form, you will be prompted to provide details from your purchase receipt. If you cannot provide the relevant details from your purchase receipt as necessary, you cannot submit a Missing Transactions request.
After you have submitted this form, check your Sub Club Account on the Sites 48 hours after you submitted the form to learn if your request has been granted. We reserve the right to limit the amount of Missing Transactions requests that you may submit.
You may be able submit a “Missing Transactions” request form via the Sites for a purchase that has occurred within the preceding thirty (30) days. While filling out this form, you will be prompted to provide details from your purchase receipt. If you cannot provide the relevant details from your purchase receipt as necessary, you cannot submit a Missing Transactions request.
After you have submitted this form, check your Sub Club Account on the Sites 48 hours after you submitted the form to learn if your request has been granted. We reserve the right to limit the amount of Missing Transactions requests that you may submit.
11. Expiration of Points, Subway® Cash and other Rewards; Termination of Account
As used herein, “activity” is defined as any positive change to your Sub Club Account balance, the earning of any Points, Stamps, or the redemption of Subway® Cash, Free Footlong Coupon or other Reward.
Points earned expire after six (6) months if there has been no activity on the Sub Club Account in that six (6) month period. If your account shows any activity within that period of six (6) months, the expiration date of all your Points will be reset.
Stamps do not expire.
Free Footlong Coupons expire one (1) year from the date of issuance.
Other Rewards, obtained through promotional offers, may be subject to additional terms and conditions, including a shorter expiration date, which will be stated in the applicable promotional offer.
If you don’t redeem your Free Footlong Coupon or Reward by the pre-identified expiration date, it will no longer be valid; and it will be deducted from your account.
Without notice to you, we reserve the right to terminate or suspend your account in the event that your account is inactive for more than twelve (12) months.
Points earned expire after six (6) months if there has been no activity on the Sub Club Account in that six (6) month period. If your account shows any activity within that period of six (6) months, the expiration date of all your Points will be reset.
Stamps do not expire.
Free Footlong Coupons expire one (1) year from the date of issuance.
Other Rewards, obtained through promotional offers, may be subject to additional terms and conditions, including a shorter expiration date, which will be stated in the applicable promotional offer.
If you don’t redeem your Free Footlong Coupon or Reward by the pre-identified expiration date, it will no longer be valid; and it will be deducted from your account.
Without notice to you, we reserve the right to terminate or suspend your account in the event that your account is inactive for more than twelve (12) months.
12. Combining Reward Offers
Subway® Cash, Free Footlong Coupons and Rewards may be combined unless otherwise noted. Multiple Rewards cannot be combined and used on the same item.
13. NO WARRANTIES; LIMITATION OF LIABILITY
EXCEPT TO THE EXTENT PROHIBITED BY APPLICABLE LAW AND WITHOUT LIMITING THE GENERALITY OF THE DISCLAIMERS OF WARRANTIES OR CONDITIONS IN THE SITE TERMS OF USE, THE SITES AND SUBWAY® SUB CLUB ARE PROVIDED ON AN "AS IS" AND “AS AVAILABLE” BASIS WITHOUT ANY CONDITIONS, REPRESENTATIONS, OR WARRANTIES OF ANY KIND WHATSOEVER, WHETHER EXPRESSED, IMPLIED, STATUTORY, OR OTHERWISE.
EXCEPT TO THE EXTENT PROHIBITED BY APPLICABLE LAW AND WITHOUT LIMITING THE GENERALITY OF THE EXCLUSIONS AND LIMITATIONS OF LIABILITY IN THE SITE TERMS OF USE, IN NO EVENT WILL WE OR ANY OF OUR AFFILIATES HAVE ANY LIABILITY OR RESPONSIBILITY FOR ANY AMOUNT OR KIND OF LOSS OR DAMAGE THAT MAY RESULT TO OR BE INCURRED BY YOU OR A THIRD PARTY, ARISING OUT OF OR IN CONNECTION WITH YOUR ENROLLMENT IN OR USE OF THE SITES OR SUBWAY® SUB CLUB.

14. Indemnification
You agree to indemnify, defend and hold harmless us and our affiliates from and against any and all claims (including but not limited to third-party claims), demands, complaints, actions, damages, losses, judgments, settlements, fines, costs, expenses, and liabilities (including reasonable legal fees) arising out of or in connection with your enrollment in or use of the Sites or Subway® Sub Club. We reserve, and you grant to us, the exclusive right to assume the defense and control of any matter subject to indemnification by you.

Your personal information will be treated in accordance with our Privacy Statement. We may send you order confirmations or other transactional text messages with your consent. Text STOP to opt out. Text HELP for help. Standard message and data rates may apply.
16. General
You have no ownership interest in Stamps, Points, Subway® Cash, Free Footlong Coupons, or any other Rewards. Use of the word "earn" in marketing materials in relation to Subway® Sub Club shall mean "collect" and shall not infer that the Points, Subway® Cash, or any other Rewards have any value until they are redeemed. Points may not be purchased or sold and are not transferable except as otherwise stated herein. Despite our efforts to ensure accuracy, errors occasionally occur. We reserve the right to correct such errors at any time even if it affects pending Stamps, Points, Subway® Cash, Free Footlong Coupons, or other Rewards or balance in your account.
In the event of any inconsistency or discrepancy between the Sub Club Terms and other statements contained in any related materials or advertising, the Sub Terms shall prevail, govern, and control.
These Sub Club Terms, including the Site Terms of Use Order Terms constitute the entire understanding between you and us with respect to the subject matter of these Terms. These Sub Club Terms, the enrollment in or use of the Subway® Sub Club, and any claims, controversies, or disputes related to or arising therefrom are governed by the body of law in, and will be resolved in accordance with the dispute resolution provisions of, the Site Terms or Use.
We will not be liable to you or to any third party for any delay or other failure to perform under these Sub Club Terms that is due to causes beyond our control or the control of third-party fulfillment providers, including without limitation acts of God, terrorism, civil disorders, labor disputes, shortages, riot, war, strikes, acts of a public enemy, acts of any government, country, territory, political division thereof, or government agency, fires, floods, earthquakes, blizzards, other extraordinary elements of nature, epidemics, pandemics, acts or omissions of third parties, telecommunications failures, Internet failures, and similar causes and events.
