Subway® Gift Card Terms and Conditions

Subway® Gift Cards in the United Kingdom (“UK”) are issued by and remain the property of Subway Contractors B.V. (“SCBV” and collectively with its affiliates, the “Subway® Group,” “we,” “us,” or “our”).
Subway Contractors B.V. is a company registered in the Netherlands under KVK number 84498242, with its registered address located at Piet Heinkade 55 – 13th Floor, 1019GM, Amsterdam, the Netherlands.
Please note that SCBV does not sell Subway® Gift Cards. Physical Subway® Gift Cards are sold in-restaurant by participating Subway® restaurants and online by Buyatab Online Inc. (“Buyatab”). Subway® eGift Cards are sold online by Buyatab. When you purchase a Subway® Gift Card, you are entering into a contract with the relevant participating Subway® restaurant or Buyatab (as applicable) and their terms of sale will apply to your purchase (see Section 1 below for more information).
These Subway® Gift Card Terms and Conditions, together with our Terms of Use governing your access to and use of our websites and mobile apps, as applicable (collectively, the “Site(s)), apply to the registration and use of Subway® Gift Cards and together form the agreement between you and SCBV (these “Terms” or this “Agreement”).
Purchase, registration or use of a Subway® Gift Card constitutes acceptance of these Terms. If you do not agree to these Terms, do not purchase, register or use the Subway® Gift Card.
SCBV reserves the right to change, modify and/or eliminate Subway® Gift Cards, and/or all or any portion of the terms and conditions, FAQs, or guidelines pertaining to Subway® Gift Cards at any time and at its sole discretion taking the interest of you and the Subway® brand into account. Any such changes, modifications or elimination will be effective immediately upon posting the changes which may be accessed through the Site, subject only to notice that is required by applicable law, if any. If we intend to make any changes that are likely to have a detrimental effect on you or your ability to use your Subway® Gift Card, we will try to give at least 30 days’ notice of the change by posting a notice on our Site. However, it may not always be possible to give 30 days’ notice of any changes, for example where we are required by law to make the change immediately. Your continued registration or use of Subway® Gift Cards confirms your acceptance of these Terms and any changes or modifications to these Terms. You should review these Terms and our guidelines and FAQs frequently to understand the terms and conditions that apply to your continued registration and or use of Subway® Gift Cards.
For clarity, SCBV is involved in the issuance of Subway® Gift Cards, but other members of the Subway® Group operate the Sites. Neither SCBV nor any other member of the Subway® Group owns or operates any Subway® restaurants. Instead, each Subway® restaurant in the UK is owned and operated by an independent franchisee. Each Subway® restaurant is solely and independently responsible for any issues relating to the sale of products to you.

When you purchase a Subway® Gift Card, you are entering into a contract with the relevant participating Subway® restaurant or Buyatab (as applicable) and their terms of sale will apply to your purchase (see Section 1 below for more information).
These Subway® Gift Card Terms and Conditions, together with our Terms of Use governing your access to and use of our websites and mobile apps, as applicable (collectively, the “Site(s)), apply to the registration and use of Subway® Gift Cards and together form the agreement between you and SCBV (these “Terms” or this “Agreement”).

1. About Your Subway® Gift Card
Types of Subway® Gift Card
Subway® Gift Cards currently come in two forms: (i) a physical Subway® Gift Card; and (ii) an electronically transmitted Subway® eGift Card. In these Terms, the term “Subway® Gift Card” refers to both the physical version of the Subway® Gift Card and the Subway® eGift Card, except where indicated otherwise.
Purchasing a Subway® Gift Card
Physical Subway® Gift Cards can be purchased at participating Subway® restaurants in the UK and online through the dedicated Subway-branded webpage hosted by Buyatab for purchasing physical Subway® Gift Cards. Subway® eGift Cards can only be purchased online through the dedicated Subway-branded webpage hosted by Buyatab for purchasing Subway® eGift Cards.
When you purchase a physical Subway® Gift Card at a participating Subway® restaurant, you are purchasing the Subway® Gift Card directly from that Subway® restaurant. This means that your contract for the purchase of the Subway® Gift Card is with that Subway® restaurant and is subject to the Subway® restaurant’s terms and conditions of sale.
When you purchase a physical Subway® Gift Card or Subway® eGift Card online through the dedicated Subway-branded webpages hosted by Buyatab as described above, you are purchasing the Subway® Gift Card directly from Buyatab Online Inc., 850-1055 Dunsmuir St, Vancouver, British Columbia, V7X 1A3, Canada. Buyatab is wholly owned by SVS. This means that your contract for the purchase of the Subway® Gift Card is with Buyatab and is subject to their terms and conditions of sale.
Use of Subway® Gift Cards
The Subway® Gift Card balance can be used to purchase eligible goods from participating Subway® restaurants in the UK. Any remaining balance can be used towards subsequent transactions until the balance has been fully used. No change is given.
If the total price of the transaction exceeds the balance available on the Subway® Gift Card, the Subway® Gift Card can be used for part payment of eligible goods on payment of the difference using an accepted payment method.
You must present your Subway® Gift Card at the time of making a purchase in a participating Subway® restaurant, either by providing and scanning the physical Subway® Gift Card, the Subway® Gift Card in your mobile wallet*, or the relevant QR code associated with your Subway® eGift Card.
* Internet connection and compatible mobile device and operating system required to add your Subway® Gift Card to your mobile wallet.
Participating Restaurants
To find out if a particular Subway® restaurant is a participating restaurant, ask the applicable Subway® restaurant or call ahead to confirm it is a participating restaurant prior to making a purchase. You may also check the participating restaurant list. SCBV cannot guarantee acceptance of your Subway® Gift Card at all Subway® restaurants because Subway® restaurants operate as independent franchises.
Restrictions
Subway® Gift Cards can be used in person at participating Subway® restaurants in the UK or for online orders placed through the Subway® App for in-restaurant collection from those participating restaurants, but cannot be used for online orders placed through third-party online ordering services.
Subway® Gift Cards cannot be used to buy additional Subway® Gift Cards.
Except where required by law, Subway® Gift Cards are not refundable or exchangeable for cash.
Subway® Gift Cards cannot be purchased or used for commercial purposes and cannot be resold or transferred for value without our prior written consent.
The Subway® Gift Card is not a credit or debit card, and no credit card, overdraft protection, deposit account, or depository insurance is associated with it.
Expiration
The Subway® Gift Card balance expires 12 months from the date of the last load. Any balance remaining at the end of this period will expire automatically and be lost. You are solely responsible for ensuring you are aware of the relevant expiry dates and no reminders will be provided.
Fees
You will not be charged any fees in connection with your use of the Subway® Gift Card.
Loading / Reloading Your Subway® Gift Card
Subway® Gift Cards can be loaded/reloaded with pounds sterling (GBP / £) only.
You can load/reload your Subway® Gift Card balance in several ways. Physical Subway® Gift Cards may be loaded/reloaded at participating Subway® restaurants using cash or a credit/debit card, and may also be loaded/reloaded online via the dedicated Subway-branded webpage hosted by Buyatab for loading/reloading Subway® Gift Cards using a credit/debit card. Subway® eGift Cards may only be loaded/reloaded online via the dedicated Subway-branded webpage hosted by Buyatab for loading/reloading Subway® Gift Cards using a credit/debit card.
If you load/reload a Subway® Gift Card at a participating Subway® restaurant, the contract for your purchase is with the participating Subway® restaurant and their terms and conditions of sale will apply to your purchase. If you load/reload a Subway® Gift Card online, the contract for your purchase is with Buyatab Online Inc. and their terms and conditions of sale will apply to your purchase.
A minimum load/reload of £5 applies to online loads/reloads.
The maximum value that can be associated with any one Subway® Gift Card at any given time is £250. The maximum value that can be associated with a Subway® Gift Card on any calendar day, between beginning balance and reload activity, is £250. No single individual may purchase Subway® Gift Cards with a total value of more than £250 per card and/or £2,000 per order and/or £10,000 in total on any calendar day.
The Subway® Gift Card need not be registered/linked to your Subway Rewards® account for it to be loaded/reloaded.
Balance
You can check the balance on a Subway® Gift Card at participating Subway® restaurants or online with the Subway® Gift Card Balance Checker.
PIN
Your Subway® Gift Card has a Card Number and a Personal Identification Number (“PIN”) associated with it. On physical Subway® Gift Cards, the PIN, and in some cases the card number, can be found by scratching off the silver box on the back of the Subway® Gift Card. For Subway® eGift Cards, the PIN will be contained in the email in which the Subway® Gift Card is delivered. The PIN is used to help identify you when checking your Subway ® Gift Card balance information online or when contacting customer service representatives.
Unauthorized Transactions / Replacement of Lost, Stolen, or Damaged Cards
You are responsible for all transactions associated with your Subway® Gift Card, whether authorized or unauthorized. You should, therefore, safeguard your Subway® Gift Card and treat it with the same care as you would with cash.
If you have linked a Subway® Gift Card to your Subway Rewards® account and believe someone has obtained unauthorized access to your account information, you should change your password immediately and contact Guest Care through the “Contact Us” page on the Sites. You should ensure that your password is unique to your Subway Rewards® account and has not been used for any other purpose. You should also reach out to your financial institution and follow its dispute resolution policy if you believe that charges were made to any credit or debit card on file without your authorization.
If you have a Subway® Gift Card and it is subsequently lost, stolen, damaged, or otherwise rendered non-functional, or if you believe that someone has copied your Subway® Gift Card, contact Guest Care through the “Contact Us” page on the Sites; However, your Subway® Gift Card will be replaced only if the Subway® Gift Card is linked to Subway Rewards® account or proof of purchase is provided.
SCBV is not responsible for any unauthorized use of your Subway® Gift Card before your account balance is frozen.
Fraud
SCBV reserves the right to refuse to accept or otherwise limit the use of any Subway® Gift Card and/or Subway® account if SCBV reasonably believes the use is unauthorized or unlawful.
Registration
Linking your Subway® Gift Card to your Subway Rewards® account constitutes registration of your Subway® Gift Card. Registration is optional — You can still use your Subway® Gift Card to make purchases in person at participating restaurants without linking it to a Subway Rewards® account.
To create a Subway Rewards® account and link your Subway® Gift Card, visit the Subway Rewards® page, download the Subway® App and follow the onscreen instructions.
By creating a Subway Rewards® account, eligible customers will be enrolled in the Subway Rewards® program, which is subject to additional terms and conditions (see Section 2 below).
Each customer is permitted to maintain only one Subway Rewards® account and must be 18 years of age or older to create an account. Each customer must also submit a valid email address which Subway® Group or its designees will use to contact them about their account and as otherwise permitted by applicable law.
You may also sign up to receive promotional messages and communications sent to you by email, SMS, other computer electronic messaging such as Facebook Messenger on the Sites, or via push notifications. You may unsubscribe from promotional commercial messages at any time by changing your preferences in your account or opting out via the unsubscribe link at the bottom of the email message, or by following the opt-out instructions in the applicable SMS message or other computer electronic message as specified in the message. You may opt out of receiving push notifications at any time by changing your device settings. Even if you opt out of receiving promotional messages or push notifications, you understand and agree that the Subway® Group may continue to send you service messages concerning your account.

2. The Subway Rewards® Program
Subway® Gift Cards can be used in conjunction with the Subway Rewards® program, which is administered separately and is subject to additional terms available at Subway Rewards® terms. Participation in the Subway Rewards® program constitutes acceptance of those additional terms.
Subway Rewards® points are not earned on taxes, fees, when purchasing a Subway® Gift Card, when loading/reloading a Subway® Gift Card, or on orders placed with third-party delivery partners.
To earn points on eligible purchases made in person at participating Subway® restaurants, you must identify yourself as a Subway Rewards® member by scanning your member account QR code in the Subway® App before completing the purchase.
To earn points on eligible purchases made online through the Subway® App for in-restaurant collection from a participating restaurant, you must be logged into your Subway Rewards® account when placing the order. Online orders placed through the Subway® App are subject to additional Order Terms.

3. NO WARRANTIES; LIMITATION OF LIABILITY
SCBV has a legal duty to provide goods and services that are in conformity with its contract with you. This means that goods provided to you must be as described, fit for purpose and of satisfactory quality and services must be provided with reasonable care and skill. Advice about consumer rights is available from Citizens Advice (www.citizensadvice.org.uk/) and Trading Standards (www.gov.uk/find-local-trading-standards-office).
Nothing in these Terms affects your consumer rights and SCBV does not limit or exclude liability for death or personal injury caused by its negligence, or for fraud or for any other matter in respect of which it would be unlawful to limit or exclude liability.
If SCBV is negligent or breaches the contract with you, SCBV is liable to you for foreseeable loss or damage that you suffer as a result. The term “foreseeable” means that, at the time the contract was made, it was either clear that such loss or damage would occur or both parties knew that it might reasonably occur, as a result of something Subway® did (or failed to do).
SCBV and other members of the Subway® Group are not responsible for loss or damage that: (i) was not foreseeable; (ii) was not caused by their breach of contract or negligence; (iii) was caused by an event or circumstance outside their reasonable control; or (iv) you could have avoided by taking reasonable action. SCBV and other members of the Subway® Group are not responsible for any business loss or damage.
Nothing in these Terms affects your consumer rights and SCBV does not limit or exclude liability for death or personal injury caused by its negligence, or for fraud or for any other matter in respect of which it would be unlawful to limit or exclude liability.

SCBV and other members of the Subway® Group are not responsible for loss or damage that: (i) was not foreseeable; (ii) was not caused by their breach of contract or negligence; (iii) was caused by an event or circumstance outside their reasonable control; or (iv) you could have avoided by taking reasonable action. SCBV and other members of the Subway® Group are not responsible for any business loss or damage.
4. General
Despite SCBV’s efforts to ensure accuracy, errors occasionally occur. SCBV reserves the right to correct such errors at any time, even if it affects the Subway® Gift Card value balance. If the Subway® Gift Card is loaded/reloaded or delivered with a value balance lower or higher than what was charged to the payment method, SCBV reserves the right to cancel the incorrect value transaction and re-apply the correct value to the card and the right to cancel the card and re-issue one at the correct value. In the event that SCBV is unable to do so remotely, SCBV will use commercially reasonable efforts to facilitate a resolution with the relevant participating Subway® restaurant or Buyatab Online, Inc. (as applicable).
SCBV will not be liable to you or to any third party for any delay or other failure to perform under these Terms that is due to causes beyond our control or the control of third-party fulfillment providers, including without limitation acts of God, terrorism, civil disorders, labor disputes, shortages, riot, war, strikes, acts of a public enemy, acts of any government, country, territory, political division thereof, or government agency, fires, floods, earthquakes, blizzards, other extraordinary elements of nature, epidemics, pandemics, acts or omissions of third parties, telecommunications failures, Internet failures, and similar causes and events.
Another party, including any successor or designee of SCBV may be substituted as the Subway® Gift Card issuer and sole obligor without the cardholder’s consent. If a new party becomes the Subway® Gift Card issuer, the former Subway® Gift Card issuer is released from all liability to the Subway® Gift Card holder or any other party.
These Terms are governed by the laws of England and Wales. This means that any disputes or claims arising out of or in connection with these Terms (including non-contractual disputes and claims) will be subject to the laws of England and Wales. However, if you are resident in a different part of the UK, you will retain the benefit of any mandatory protections given to you by the laws of that part of the UK where you are resident. Any disputes will be subject to the non-exclusive jurisdiction of the courts of England and Wales. This means that you can choose whether to bring a claim in the courts of England and Wales or in the courts of another part of the UK in which you are resident.
